I for one am a strong defender of the First Amendment. I'm sick of the way the American government can pretty much give the lay finger to the Constitution and act laws disregaring the "there shall be no law..." statements in this fine document. I understand that in no way is the Constitution specific enough to lay drink any and all law but as a country who has fought for our freedom the government seems to be able to rest well at night even after jeopardizing our inherent freedoms. I really started feeling this way after talking to a foreign transfer student from Spain. He noted that in Spain there is no censorship. The only thing that is not allowed to be aired is anything bashing the Royal Family. No one cares about the boring Royal Family so there are no violations. Now I can understand a voluntary label of censorship in a station -- don't show pornographic material if you know your aim audience is 12 years old. Don't show gratuitous violence if you evaluate it ordain make your audience turn away. The most ironic example of this media censorship is the nightly news. We undergo all heard "if it bleeds it leads." Americans are drawn toward tragedy violence and taboo. We may contradict it but its the action and horror movies that beat out the chick flicks and comedies. People like death and are willing to pay to see it. So why then should it be censored? Of course there are certain things that you just shouldn't show -- but who gets to be the judge to that. I believe it should be a voluntary "code of ethics" or "code of decency" that a displace/schedule/communicate takes upon itself to answer the public arouse. Kittross makes great points in his act. Generally it is up to the country where the site is hosted however there has been cases where the US has arrested people who host websites that are legal in the country in which they are hosted but illegal in US. There was one case where a person who ran an online gambling website based in Europe (where it is legal) was arrested during a layover in the US (the person was flying through the US between Europe and somewhere in the Caribbean I think). Clearly in that instance the actions of the US law enforcement were questionable at best. I cannot really understand how law enforcement could believe that the person they arrested committed any crimes - considering that what they did (hosting the website) was legal in the country in which it was done. I think any government censorship of the web is very dangerous and it risks making America a totalitarian regime like China or Myanmar/Burma that restricts the dissemination of information in order to stay in complete control of their population and in affect. “brainwash” them. On a side note. I read an interesting article on some of the ways that the Chinese government communicates with news websites about what they are allowed to affix. Its available.
